Terms and conditions of a licence to erect scaffolding / hoarding / fencing on a highway

You are taking all necessary precautions to safeguard pedestrians and all other traffic (please ensure that uprights are coloured yellow and shoes are placed on bars).  Walkways must be adequately lit during hours of darkness, by additional lighting provided by the Licensee if necessary.

You are providing an adequate footway clear of obstruction for pedestrians (ie no rakers to obstruct footpath / no side rakers) under the scaffolding, maintaining a 2.1 metre headroom with full overhead cover and a clear 1.2 metre width of footway. If the use of rakers is unavoidable then an alternative provision for pedestrians must be provided alongside the scaffolding using barriers etc.  For all works on or affecting the highway, the provisions of Sections 65 and 124 New Roads and Streetworks Act 1991 must be adhered to at all times.

You are accepting responsibility for making good any damage to the footway / carriageway or highway by reason of the existence of the scaffolding / fencing.

Prior permission must be sought from the Public Lighting Department for works encompassing lighting columns. We must have 24 hour access to these columns for maintenance or emergency purposes.

Provision of Traffic Light Control where carriageways are reduced to one lane during scaffolding erection.

You are accepting responsibility for all claims or actions which may arise by reason of the existence of the scaffolding / fencing.

You are removing the scaffolding / hoarding / fencing as soon as the work is completed.

The designated footway must be kept clear at all times.

Reflector tapes are required on the posts of scaffolding or corners of the hoarding / fencing to warn pedestrians or road users.

Your attention is drawn to the requirements of the Highways Act 1980, sub section 175a (Disabled Persons).  Works must not unnecessarily obstruct the free passage of blind and disabled people.  Ramps and barriers should be provided where required for their protection and guidance.

Scaffolding must be erected out-of-hours (for example, after 6.00pm and before 8.00am or on a Sunday only) if within the confines of a pedestrianised or shopping area and debris netted from the first elevation upwards

Terms and conditions agreed with council officers / representatives during site meetings and / or any other correspondence must be adhered to.

All scaffolding must have the name and telephone number of the firm visible for emergency purposes.
